Bank is condemned to indemnity worker harassed morally by supervisor
March 20, 2018
The 2nd pole of the work of Lowland Grande condemned a bank to pay compensation for moral damage to a maid who suffered constant bullying. The institution's supervisor has been accused of a series of conducts such as discrimination against the company's women, verbal abuse and requests for illegal conduct. According to the worker, the stalker always used an aggressive tone of voice, pimps and constant threats during meetings for the use of illicit practices, such as the married sale of products. When she pointed out that practice is expressly prohibited by consumer law the stalker said in front of all the co-workers that the author and the other colleagues (all women) in the same sector looked like the "virgins of the brothel". With always macho conduct, he said in the meetings that he preferred to work with men, since women cried for anything, because it was common for some worker to leave crying from their meetings after hearing the screams of the supervisor. The workers of the company made a complaint in the Union that decided to organise a meeting in the agency to explain the causes and effects of bullying. The attempt to discourage the stalker, however, was failed, since he left the room to not hear the lectures. By defending himself from the process, he denied all the facts claiming that the worker had never been humiliated or harassed morally or sexually in the work environment. The story told by the worker was confirmed by the witness in the process, who also suffered from the harassment while working at the agency. During his testimony, the witness added that the meetings presided over him were always exalted, said, for example, phrases like "Today we will make insurance" and had all employees repeat as if they were children. He also told me that she was threatened to be fired for cause if she did not match the goals he had established. Judging the case, Judge Leda Borges, acting in the second pole of the work of lowland Grande, explained that the application of the compensation for moral damages is justified because the supervisor was extremely rude in the treatment with the employees. He spoke in screaming meetings, demanding also the practice of selling married by the maids, which showed, according to magistrate, total disregard for the psychic integrity of the worker. Magistrate also pointed out that the demand for married sale affronts the psychological integrity of the worker and is moral damage, to the extent that the employees feel obliged to practise illicit act at last, considered intolerable the practice of making the Employees repeat in chorus phrases like "Today we will make insurance". "There is no way of considering that the employee, in this situation, does not feel constrained or even exposed to ridicule. For these reasons, I have set up the illicit conduct of the defendant perpetrated by the conduct of the author's supervisor, as well as the moral damage that arises from the offence itself and which still became clairvoyant before the testimony of the witness, "he concluded. It is the appeal of the decision. Source: TRT 23
